Terms of Service Terms of Service By submitting the Guaranteed Finance Affiliate Program signup form you acknowledge that you have read these terms and conditions, understand, and agree with them. 1. Joining the Program. By submitting this form you will be applying to become an affiliate. If accepted by us as an affiliate you agree to be bound by the terms of this agreement. Your participation in the program is solely for this purpose: to legally advertise and/or promote our website(s), services and products and/or pass customer leads to us to receive a commission on product or service applications, leads or sales (as specified in each program description) made by your referral customers. This agreement is made between YOU (affiliate or lead provider) and US (G Finance, 3 Queens Road, Brighton, East Sussex, BN1 3WA. 2. Terms of the agreement. These terms will begin upon your signup with the affiliate program and will end when your affiliate account is terminated. We reserve the right to update these terms from time to time without notice to you. We recommend you regularly revisit the terms page (a link is located in your member's login area) to ensure you have seen and are aware of our latest terms. We reserve the right to vary the terms at any time. If any modification to the terms is unnacceptable to you, you have the option to terminate your affiliate account if you so wish. Your continuing participation in the program will constitute your acceptance of any change. 3. Revocation of Affiliate Status Your affiliate application and status in the program may be suspended or terminated without notice for any of the following reasons: - Inappropriate advertisements (False claims, misleading hyperlinks). - Spamming (mass email, mass newsgroup posting, other unsolicited activity etc...). - Consistantly providing leads that fail to meet a minimum criteria. - Advertising on sites containing/promoting illegal activities. - Advertising on sites we deem to be inappropriate. - Violation of intellectual property rights. - Or for any other reasonable reason at our discretion. 4. Affiliate Links / Lead Provision. You may (by prior arrangement) send us leads via http post, email, spreadsheet file or by any other agreed medium. You may use graphic and text links on your website, blog site and in emails. Our products and services may also be advertised 'offline' in classified ads, magazines and newpapers. You may use the graphics and text provided to you by us, or you may create your own as long as they are deemed appropriate and are in accordance with the conditions in clause 2. 5. Affiliate Tracking. When you send a lead to us your affiliate ID will be used to track and assign the lead to your account. When a web surfer clicks through your affiliate link a cookie is set that contains your affiliate ID. Also, their IP address is tracked in the database along with your affiliate name and a timestamp. When this person decides to apply for a service, complete or finalise an application buy a product, our software will look for this cookie and/or try to match their IP address to identify the affiliate who will be awarded the commission. Visitors sent through your affiliate link may make a purchase or apply for a service later in time and the commission will still be awarded if the cookie is present in their browser and/or they are using the same IP address as the one logged in the database. 6. Signup Bonuses / Credits. Upon signing up with our program, you may or may not receive signup bonuses or credits to your affiliate account. These can amount to some form of cash equivalent. These signup bonuses or credits will only be paid out when you have reached the minimum payout amount designated by our Affiliate Program. You cannot redeem these credits for anything else other than what they are, and will not be dispersed until you have generated enough commissions that is equal or greater than the minimum payout amount. If you do not generate any commissions at all within a period of 1 year, GuaranteedFinance reserves the right to revoke and cancel any signup bonuses credited to your affiliate account due to lack of performance. 7. Commission. Commissions payable are outlined in each program detail/description or by way of an insertion order or commission statement. Depending on which product or service you refer customers to commission may be payable for leads, clicks, applications, completed applications and or sales. Commission amounts showing as due are not final - We monitor each lead, application and sale to ensure validity, criteria match and compliance. Duplicate, invalid and non qualifying leads (see section 8 below) will be adjusted from any totals due. We also reserve the right to deduct retrospectively from commissions due monies where leads or sales are subsequently found to not qualify for payment (see section 8 below). We also reserve the right to revoke any commission for leads or sales generated by you if we do not receive remuneration or payment for those leads from the receiving third party merchant. We also reserve the right to revoke commission for any leads or sales we deem to have been made unlawfully. We reserve the right to change commission rates at any time. 8. Lead/Sales Qualification. Commission for the supply of leads or the referral of customers to the products or services we offer is subject to the lead or customer details matching the appropriate criteria for that product or service. These are the minimum requirements for all lead types, products and services: Must provide customer's: First name Surname Address Valid, contactable email address At least one valid, contactable telephone number Customer must: Be in part time or full time employment Be over 18 years of age Be a full time UK resident Not be unemployed, retired or in receipt of income support or job seekers allowance. In addition the lead must not: Be a duplicate on our system Have invalid or missing critical information Full program specific criteria details can be found in the program detail/description in the affiliate member login area. 9. Liability. We will not be liable for indirect or accidental damages (loss of revenue, commissions) due to affiliate tracking failures, loss of database files, non-payment by third party merchants and any results of 'intents of harm' to the program, our websites or servers. We do not make any expressed or implied warranties with respect to the affiliate program and/or products/services made available at this site. We make no claim that the operation of the affiliate program and our websites will be error-free and we will not be liable for any interruptions or errors. 10. Business Details.
